Livegage, Inc. (“Livegage,” “we,” or “us”) is committed to the privacy of our customers, website visitors, and users of our products and services. This privacy policy (“Privacy Policy”) discloses what personal information is gathered about visitors to our website (“Website”) and users of our products and services, including our artificial intelligence driven platform (the “Platform”), how we may use and share the personal information and the choices that are available to you with respect to our handling of your data.

We refer to the Website and the Platform together as the “Services.”

Please note that when we receive or process information on behalf of one of our clients, the processing of that information is governed by our client’s privacy policy. When we collect Personal Information as a third party service provider (the data processor as defined by data protection laws), we do so solely to provide services to lending institutions, mortgage loan servicers, or other third parties (the data controllers as defined by data protection laws). The privacy policies of those lending institutions, mortgage loan servicers, or other third parties shall apply, and you should refer to those privacy policies and/or contact them to understand how your Personal Information will be used. We provide services to lending institutions and mortgage loan servicers, and, in some cases, their websites collect information.

Those parties are responsible for taking action or making changes to any consumer information submitted through those websites.

We may change this Privacy Policy from time to time. If we do so, we will post the updated policy on our Website and will indicate when the Privacy Policy was last revised. Unless provided otherwise, all changes will be effective immediately upon posting to the Website. WHAT IS PERSONAL INFORMATION?

    • We may receive Personal Information about you from third parties that provide services to us through or in connection with the performance of our Services to third parties, including third parties licensing our software applications, such Complai, our mortgage servicing application.
    • We may receive Personal Information related to your use of our Website from third party analytics providers.

Please note, we may combine the Personal Information and other content and information we receive about you from multiple sources, including, without limitation, Personal Information we collect directly from you and one or more Third Party Sources.

Personal Information Collected as a Third Party Service Provider

Except in certain limited circumstances relating to potential employment opportunities with us, in almost all cases, Livegage is receiving Personal Information in its capacity as a third party service provider to a mortgage lender or mortgage servicer. In such cases, we may collect or receive Personal Information about or from individuals for the sole purpose of providing services to or on behalf of such mortgage lenders or services. In cases where Livegage is providing services to or on behalf of such mortgage lenders or servicers, we do not share consumer information with third parties, other than (1) those with which the mortgage lender or servicer has contracted to interface with the Livegage application, (2) those which Livegage has contracted with in provision of those services, (3) law enforcement or other governmental authority in connection with an investigation, civil or criminal subpoenas, court orders, discovery, or legal process, or (4) as directed by the mortgage lender or servicer. The privacy policies of those mortgage lenders or services shall apply, and you should refer to those privacy policies and/or contact your mortgage lender or servicer to understand how your Personal Information will be used by such mortgage lenders or servicers.

 

3.       HOW WE USE PERSONAL INFORMATION

The primary purposes for which we use Personal Information are:

  • Customer Service and Customer We may use Personal Information to (1) respond to requests for information, (2) provide customer service, and (3) for those purposes in which you authorize or instruct us to use your Personal Information.
  • Business Purposes. To operate our Website and provide our Services, we may share Personal Information with certain third parties. The third parties that we may share Personal Information with include:

As noted above, Personal Information obtained by Livegage as a third party service provider to mortgage lenders or mortgage servicers is governed by the privacy policies of those mortgage lenders or services, and you should refer to those privacy policies and/or contact your mortgage lender or servicer to understand how your Personal Information will be used by, and with whom such Personal Information will be shared with, such mortgage lenders or servicers.

Livegage does not provide services or market to individuals and does not share Personal Information it collects or Personal Information it receives from its clients with nonaffiliated third parties except as described in this Privacy Policy or as otherwise permitted by law.

 

5.       WEBSITE ANALYTICS

We may use cookies and other related technologies on our Website for operational purposes and to perform analytics. We have enabled and implemented Google Analytics on the Website. To prevent Google from using data collected by Google Analytics, follow the instructions to download and install the Google Analytics Opt-out Browser Add-on for each web browser you use. Using the Google Analytics opt-out browser add-on will not prevent us from using other analytics tools and will not prevent data from being sent to the Website itself or to Google. When you leave our Website or Platform and go to another linked site, we are not responsible for the content or availability of the linked site. Please be advised that we do not represent either the third party or you, if you enter into a transaction on the third-party site. Further, the privacy and security policies of the linked site may differ from ours.

 

10.   SOCIAL MEDIA SITES

Our online Services may use social media plug-ins to enable you to easily interact with certain social media websites (e.g., LinkedIn, X) and share information with others. When you visit our online Services, the operators of the available social media plugins can place a cookie on your device enabling such operators to recognize individuals who have previously visited our online Services. If you are logged into these social media websites while visiting our online Services, the social media plugins allow the relevant social media website to receive information that you have visited our online Services or other information. The social media plugins also allow the applicable social media website to share information about your activities on our online Services with other users of the social media website.

 

11.   DE-IDENTIFIED / AGGREGATED DATA

We may aggregate or de-identify Personal Information we collect through our Services and when operating our business. For example, we may aggregate Personal Information to calculate the percentage of users in a particular zip code. Once information or data has been de-identified and/or aggregated, such information is no longer Personal Information.

 

12.   INTERNATIONAL USERS

Our Services are operated in the United States and intended for users located in the United States. Like almost every website, our Website can be accessed by an international audience. If you are located outside of the United States, please be aware that information we collect, including Personal Information, will be transferred to, processed, stored and used in the United States. The data protection laws in the United States may differ from those of the country in which you are located, and your Personal Information may be subject to access requests from governments, courts, or law enforcement in the United States according to laws of the United States. 13.   CALIFORNIA RESIDENTS

California Civil Code Section 1798.83 permits customers of a company who are California residents to request and obtain from us once a year, free of charge, information about the Personal Information (if any) we disclosed to third parties for the third parties’ direct marketing purposes in the preceding calendar year. If applicable, this information would include a list of the categories of Personal Information that were shared and the names and addresses of all third parties with which we shared information in the immediately preceding twelve (12) calendar months. California Consumer Right to Restrict Processing of Sensitive Personal Information. You have the right to request the restriction of processing of your Sensitive Personal Information. At this time, however, we do not use or disclose Sensitive Personal Information for purposes other than those expressed herein or otherwise permitted by applicable law, and these uses cannot be limited under California law.

We do not sell Personal Information and have not sold Personal Information at any time in the preceding twelve (12) months. We do not direct or target our Website to anyone under the age of 18 and we do not allow anyone under the age of 18 to use our Services. We will make reasonable efforts to remove such information from our databases.

For individuals interested in job opportunities with us, the Website may allow prospective employees to request additional job opportunity information and apply for a job online. We, or our third party service providers, may use the Website to collect Personal Information from prospective employees for human resources recruitment purposes.
